1 What is personal data and what is processing

Personal data is information that identifies or can identify, directly or indirectly, a natural person and that can provide information on his or her characteristics, habits, personal relationships, etc. The following are considered personal data, by way of example but not limited to: name, surname, address or other contact details, an identification number or an online identifier.

A processing operation is any operation performed with or without the aid of automated processes and applied to personal data. The following are considered as processing, by way of example but not limited to: the collection, recording, organisation, storage, modification, consultation, deletion or destruction of data.

2 What personal data are processed

  1. Navigation data

    The computer systems responsible for the operation of the site acquire, in the course of their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with identified interested parties, but by its very nature could, through processing and association with data held by third parties, allow the User to be identified. This data includes the IP addresses or domain names of the computers used by the User to connect to the Site; the URI addresses of the resources requested (Uniform Resource Identifier); the time of the request, and other parameters relating to the User's operating system and computer environment. This data is used for the sole purpose of obtaining anonymous statistical information on the use of the site to check its correct functioning, to identify anomalies and/or abuses, and is deleted immediately after processing. The data could be used to ascertain responsibility in the event of hypothetical computer crimes against the Owner or third parties

  2. Data provided by the User

    The User's data are collected by the Controller when the "Contact us" form or the "Work with us" form is filled in by filling in a form (henceforth referred to as "form"). The form requires the entry of different types of personal data depending on the service requested and the related legal obligations. Common data: This includes personal data (such as first name, last name); contact data (such as email); the CV should the user send it as an attached file in the event of interest in one of the job positions listed in the "Work with us" section (TK reminds the user that should the user wish to provide the company with information relating to his/her person that falls under the scope of so-called special data, such data may only be processed if the user has given his/her explicit consent in the copy of the CV attached to the email. TK in any case invites the user not to indicate any particular data, except those that are deemed absolutely essential by the user for an adequate assessment of his/her application).

3 Purposes of processing

The User's personal data will be processed for the following purposes:

  1. Responding to the user's requests by providing general information on the services offered By TK and other companies operating under the tk.digital brand.;
  2. Providing feedback to potential candidates in relation to professional positions open in the "Work with us" section;
  3. To send the user communications/notifications regarding the service;
  4. Fulfilling obligations required by law or regulation and fulfilling requests from the competent authorities;
  5. Exercise by the Owner the right of defence (extrajudicial, judicial);

4 Legal prerequisite for the processing of your data

Each processing of your personal data is justified by one of the following legal prerequisites:

  • Pre-contractual/Contractual: The processing is necessary to perform a contract between the parties. 
  • Legal obligation: The processing is necessary to fulfil a legal obligation. 
  • Legitimate interest: Processing is necessary for the pursuit of the legitimate interest of the Controller, provided that the interests or fundamental rights and freedoms of the User, which require the protection of personal data, do not prevail. 
  • Consent: Processing is only possible if the User has given consent for specific purposes. In this case, the User may revoke the consent previously given at any time

5 To whom the data may be disclosed

As part of the TK activity and for the purposes specified above, the User's personal data may be shared with:

  • Duly appointed Data Processors who provide specific processing or ancillary services on behalf of the Data Controller and under its instructions; the User may at any time request an updated list of Data Processors;
  • Companies operating under the brand name tk.digital;
  • Autonomous Data Controllers to whom the data may be communicated pursuant to provisions of law or orders by the Authorities; to allow the Data Controller to exercise his/her rights (law firm);
  • Persons authorised by the Data Controller to process personal data necessary to carry out activities strictly related to the provision of services and who have assumed an appropriate legal and contractual obligation of confidentiality (e.g. employees and/or collaborators of the Data Controller).

We do not sell or otherwise disclose the User's personal data to third parties

6 Where the data are stored

All personal data is stored in electronic form on servers located in the EU.

If necessary, the Controller may also transfer the data outside the EU. In this case, the Controller hereby ensures that the transfer of data outside the EU will take place in accordance with the applicable legal provisions.

7 How long data is stored

Your personal data is processed following the implementation and continuous updating of appropriate technical and organisational security measures aimed at preventing the accidental loss, unauthorised use or access, alteration or disclosure of your personal data. 

We only retain your personal data for as long as is necessary to fulfil the purposes for which we collected it, including to meet any legal, accounting or reporting requirements.

In determining the appropriate retention period for personal data, we consider the amount, nature and sensitivity of personal data, the potential risk of harm from unauthorised use or disclosure of personal data, the purposes for which we process personal data and whether we can achieve those purposes by other means, and applicable legal requirements.

8 Minors

Minors under 16 years of age must not provide information or personal data to the Controller without the consent of those exercising parental responsibility over them. Without this consent, it will not be possible for minors to send requests via the website.

TK takes the privacy of children seriously. It therefore invites all those exercising parental responsibility over minors to inform them about the safe and responsible use of the Internet and the Web.

9 What are the User's rights

You may at any time request confirmation as to whether or not personal data relating to you are being processed, and in relation to such data you have the right to: 

  • request access to the data in order to obtain information on the purposes pursued by the processing, the recipients to whom the data may be disclosed, the duration of the processing (where possible) and the possible consequences of processing based on profiling;
  • withdraw consent at any time, without prejudice to the lawfulness of processing based on consent given prior to the revocation;
  • request the rectification of personal data should they be inaccurate or incomplete
  • request the deletion of data if they are no longer required by the Controller for the purposes of the processing envisaged, are inadequate with respect to the purposes of the processing, the User has revoked his/her consent or the data have been processed unlawfully
  • request the restriction of data processing, in the cases provided for by law
  • request the transfer of the data to another Data Controller, in a commonly used, machine-readable format, without hindrance from the current Data Controller;
  • object to the processing of your data and, specifically, you have the right to object to decisions concerning you if they are based solely on automated processing of your data, including profiling
  • refer the matter to the competent authority if he considers that the processing operations concerning him violate current data protection legislation.

10 Automated decision-making process

The User is not subject to decisions based on automated processing.

11 Amendments

TK reserves the right to change or simply update the content of this Privacy Policy, in part or in full, including due to changes in applicable law. Such changes will be binding as soon as they are published on the Website. If the user continues to access or use the service after such publication, it is assumed that they have expressly accepted these changes. TK therefore invites the User to regularly visit this section to become acquainted with the most recent and up-to-date version of the Privacy Policy in order to keep abreast of the data collected and the use made of such data by TK.
